Kota Kinabalu: A company was charged with installing passenger lifts without a valid certificate issued by an officer from the Department of Occupational Safety and Health (DOSH) or an authorised person.
Kinabalu International Hotel Sdn Bhd, through its representative, pleaded not guilty before Sessions Court Judge Amir Shah Amir Hassan to the charge against the company on Wednesday.
The company is accused of permitting the operation of machinery installations namely, passenger lifts without having a valid certificate issued by an authorised officer or licensed person at 11.30am on Oct 7, 2025, at the Hyatt Regency Kinabalu in Jalan Datuk Salleh Sulong, here.
The offence is under Section 27D(1) of the Occupational Safety and Health Act 1994 and is punishable under Section 27D(5) of the same Act, which provides for a fine of up to RM100,000, or a jail term of up to one year, or both, upon conviction.
The court set April 28 this year for mention and offered the company bail of RM5,000, with one local surety, without deposit.
Prosecuting Officer Christy Claire De Guzman from DOSH appeared for the prosecution, while counsels Vanessa Maria Marimuttu and Adele Chin represented the company.
In another case, three illegal immigrants were jailed four months each for entering the state illegally.
The trio admitted separately to entering Sabah without valid documents.
They were arrested by an Immigration team during an operation carried out in the city recently after they failed to produce their identification documents.
After completing their jail sentences, which they requested to commence from the date of arrest, they were ordered to be referred to the Immigration Department for further action.
