Kota Kinabalu: A 34-year-old shop manager was fined RM3,000 or 30 days’ jail for selling a product containing poison.
Hui Jun Seng pleaded guilty before Sessions Court Judge Zaini Fishir on Wednesday.
Hui was found selling one box labelled “Hovasc 10mg”, containing 10 white tablets that were found to contain Amlodipine, a poison listed under the First Schedule of the Poisons Act 1952.
The charge stated that he sold the product at retail to a man as dispensed medicine without a prescription from a registered medical practitioner at noon on Feb 14, 2024 at Public Chemist (Sabah) Sdn. Bhd. (City Pharmacy) on Jalan Pantai here.
Hui had contravened Section 21(1)(c) of the Poisons Act 1952, an offence under Section 13(b) of the same Act and punishable under Section 32(2), which provides a fine of up to RM50,000, or jail of up to five years, or both.
During mitigation, Hui, who was unrepresented, asked for leniency. However, Prosecuting Officer Lin Lay Peng from the Pharmacy Department urged the court to impose a deterrent sentence.
In another case, a 42-year-old shop assistant was ordered to pay a total fine of RM1,000 for selling unregistered products and cosmetics without notification.
Noraizan Ismail admitted to two charges.
On the first count, she was fined RM500 or 15 days’ jail for selling two products not registered with the Ministry of Health (MOH) at 2.05pm on Sept 27, 2024 at Lisa Queen Empire, KK Taipan, Jalan Tuaran, Inanam.
The products were a bottle of Maajun Bebeh and a bottle of Herba King Pil Jamu.
On the second count, Noraizan was fined another RM500 or 15 days’ jail for selling cosmetics without notification, namely a unit of Bird Nest Collagen soap, at the same place and time.
In mitigation, Noraizan asked for a minimum fine, saying she has four children to support and was unaware it was against the law as her boss did not inform her.
