Shop manager admits selling controlled medicine without prescription, fined RM3,000

Kota Kinabalu: A 34-year-old shop manager was fined RM3,000, in default 30 days’ jail, by the Sessions Court here for selling a product containing poison by retail.

Hui Jun Seng pleaded guilty to the charge before Sessions Court Judge Zaini Fishir on Wednesday.

He was found to have sold one box labelled “Hovasc 10mg” containing ten white tablets, which were confirmed to contain Amlodipine, a poison listed under the First Schedule of the Poisons Act 1952.

The offence was committed at noon on Feb 14, 2024 at Public Chemist (Sabah) Sdn Bhd (City Pharmacy) in Jalan Pantai, where he sold the product as a dispensed medicine without a prescription from a registered medical practitioner.

Hui was charged under Section 21(1)(c) of the Poisons Act 1952, punishable under Section 32(2) of the same Act, with the court hearing mitigation and the prosecution’s call for a deterrent sentence before imposing the fine.
