SANDAKAN: A 56-year-old local man was jailed eight years and 10 months by the Sessions Court here on Monday on a drug-related offence.
Judge Roslinda Razali ordered Asdar Ating to serve the sentence to run from the date of his arrest.
The court heard that Asdar was detained on Nov 19, 2025, at 1.10pm after a urine screening conducted at the Narcotics Criminal Investigation Division of the Sandakan District Police Headquarters tested positive for Amphetamine and Methamphetamine.
The presence of the drugs was later confirmed following analysis by the Pathology Department.
He was sentenced under Section 39C(2) of the Dangerous Drugs Act 1952, which provides for a jail term of between seven and 13 years and whipping of between three and six strokes.
However, he was sparred the whipping sentence due to his age, above 50 years old.
The court was told that he had a previous conviction under Section 39C(1) of the same Act on Dec 13, 2018.
The court also ordered that Asdar be placed under police supervision for two years upon completing the prison term.
Deputy Public Prosecutor Yuvan Bharathan prosecuted, while Asdar was not represented.
