Kota Kinabalu: An unemployed man was sentenced to six months’ jail by the Magistrate’s Court, Tuesday, for failing to carry his identity card with him.
Mohd Razi Haron, 27, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at 10.05pm on Sept 7, 2021 at the grounds of 1Borneo Hypermall, Jalan UMS near here.
Inspector Kelvan Elson Maik, prosecuting told the court that on the said day, Razi was detained by police on suspicion of theft and failed to produce his identity card when asked by police during screening.
Razi told the police that he is a Malaysian citizen and has a MyKad and claimed that the document had been missing since 2020 and has not applied a new one until now.
Duty counsel Lim Ming Zoong @ Lawrence, representing Razi, requested a lenient sentence and to be run from the date of his arrest, adding that Razi was a divorcee with one child and has no previous conviction.
Razi was charged under Section 25(1)(n) of the National Registration Regulations 1990, which provides for a fine of up to RM20,000 or jail term of up to three years, or both, on conviction.
The court ordered him to serve the sentence from the date of arrest.
In another case, a Filipino was jailed 13 months for rioting at the Immigration Temporary Detention Centre in Manggatal, together with several fellow inmates last year.
Pulalun Abdul Han, 28, admitted to jointly committing the offence together with 20 other inmates at the said premises, Jalan Kokol Poring-Poring, Manggatal at 6.25am on Sept 10, 2021.
He was charged under Section 147 of the Penal Code read together with Section 34 of the Criminal Procedure Code, which carries a jail term of up to two years or fine, or both, on conviction.
The other 20 foreigners had on Nov 11, Nov 24 and Dec 8 last year sentenced to 13 months’ jail each after pleading guilty to the charge.
The court ordered Pulalun to serve the sentence from the date of his arrest and to be referred to the Immigration Department after serving the sentence.
