Kota Kinabalu: A policeman was freed from a charge of having 0.24grams of syabu without his defence being called.
Magistrate Wan Farrah Farriza Wan Ghazali discharged and acquitted Corporal Sazaly Sahaji, 45, after ruling that the prosecution had failed to establish a prima facie case against Sazaly.
Sazaly was accused of having the syabu at parking lots of Inanam police quarters on July 29, 2024.
He was charged under Section 12 (2) of the Dangerous Drugs Act 1952 which carries a fine of up to RM100,000 or a jail term of up to five years or both, upon conviction.
The prosecution had called six witnesses during the prosecution stage.
Deputy Public Prosecutor Arfa Anchal Khan conducted the prosecution while counsel Mohamad Syazwan Shah, Nigel Neong Kaning and Hannan Razaini defended Sazaly.

In another case, six women and a man were jailed four months each for entering the state illegally.
Sessions Court Judge Hurman Hussain meted out the sentence on the seven illegal immigrants after they pleaded guilty separately to the charge against them.
The illegal immigrants were arrested during operations at several places in the state after failing to produce their valid travel documents when asked by the authority.
They were charge under Section 6 (1) (c) of the Immigration Act 1959/63 which provides for a jail term of up to five years or a fine of up to RM10,000 or both, upon conviction.
Immigration Department prosecuting officer Gressia Yolanda Ismail Uvaraj told the court that the illegal immigrants are Philippines nationals.
The court ordered the illegal immigrants to serve their jail sentence from the date of their arrests and to be referred to the Immigration Department after completing their jail sentences for deportation.
