Kota Kinabalu: The Sessions Court fixed Apr 9 this year for further pre-trial case management on the case of a husband charged with abetting his friend to insert fingers into his wife’s private part.
Judge Amir Shah Amir Hassan set the date for the man who was a self-employed, 35, and his friend Mohd Shahir Ibrahim, 32, when their case was brought up for case management to serve relevant documents.
The prosecution informed the court that all documents were ready to serve except the medical report and that the prosecution requested for further case management.
The man is accused of abetting with Mohd Shahir to committing the offence against the 38-year-old woman at a living room of a house in Tuaran on Jan 23 this year at 5.45am.
He was charged under Section 109 of the Penal Code and read together with Section 377CA of the same Code which provides for a jail term of between five and 30 years, and fine, on conviction.
Meanwhile, Mohd Shahir allegedly inserted his finger into the woman’s private part at the same place and time.
During the proceedings, both the man and Mohd Shahir told the court that they have nothing to say.
Deputy Public Prosecutor Bryan Francis appeared for the prosecution while the duo who claimed trial to the charge against them on Feb 4, was not represented.
The court ordered the man and Mohd Shahir to be remanded further pending the disposal of their case.
