Section 323 provides for imprisonment of up to one year or a fine of up to RM2,000, or both, while Section 326A allows for a sentence of up to twice the maximum term prescribed for the relevant offence where the victim is a spouse.
The prosecution told the court the complainant lodged a police report at the Emergency Ward of Queen Elizabeth Hospital II after sustaining a head injury caused by being struck with a glass by her husband.
Investigations found that Rickly threw a glass at the victim, causing a wound on the left side of her head that required five stitches and hospital treatment.
Further investigations revealed Rickly had been drinking with friends and was intoxicated.
The assault occurred after the victim reprimanded him for insulting a friend’s child.
Rickly was also said to have frequently scolded and beaten the victim after returning from work.
Acting on information received, police arrested Rickly at the house.
Unrepresented, Rickly requested for leniency, saying he had schoolgoing children and other responsibilities, including the need to work and pay for his house.
