Kota Kinabalu: A 35-year-old Filipino construction worker charged with murdering his wife four years ago was ordered by the High Court to enter his defence.

High Court Judge Datuk Celestina Stuel Galid ruled that the prosecution had established a prima facie case against Nul Sadam Jemsi, calling him to formally present his defence. The court set April 24 for Nul’s defence.

Nul, who holds an IMM13, is accused of killing his 22-year-old wife, Nasfidah Japarah, between 10pm and 11.47pm on March 22, 2022, in a rented room on the third floor of Block J, Segama.

The offence, under Section 302 of the Penal Code, carries either the death penalty or life imprisonment of 30 to 40 years, with mandatory whipping of at least 12 strokes for male convicts under 50 if not sentenced to death.

The prosecution called 16 witnesses during its case, with Deputy Public Prosecutor Lovely Natasha Charles standing in for DPP Dana Arabi Wazani. 

Nul was represented by counsel Jamadi Saleh and was remanded further, as the charge carries no provision for bail.
