Keeping stolen devices lands Filipino in jail
She was charged under Section 9(1) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000 or a jail term of up to six months, or both, upon conviction.
Kota Kinabalu: A 34-year-old Filipino man was jailed seven months by the Magistrate’s Court for keeping stolen electronic devices.

Khairul Kassim, who has no identity documents, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to dishonestly retaining stolen items, namely a Techlife smartwatch, a Baseus wireless charger, a Fantech wireless headset, and a Vinffier wireless speaker, at 6.20pm on Feb 3, at a rented house in Taman Union, Putatan.

He was charged under Section 411 of the Penal Code, which carries a maximum sentence of five years’ jail, or a fine, or both.

The court heard from the prosecution that the devices were among properties missing from the complainant’s house at Dah Yeh Villa near here, which had been broken into earlier on Feb 1.

Acting on information received, police arrested Khairul at 6.20pm on Feb 3 at the rented house in Taman Union, Putatan, and recovered the stolen items.

The court ordered Khairul to serve his imprisonment sentence from the date of arrest and to be referred to the Immigration Department thereafter.

In a separate case, a 32-year-old woman was fined RM1,200 or three months’ jail for possessing gambling paraphernalia.

Mar Hawati Mohd Anuar pleaded guilty before Magistrate Dzul Elmy Yunus to illegally purchasing a lottery ticket, locally known as “Hwa Hui”, on Feb 6 at 2.30pm at the five-foot-way of a shop in Inanam.

The prosecution informed the court that Mar was arrested by police following information about gambling activity in the area. 

Police also seized a handphone, a mobile printer, two illegal lottery tickets, and RM48 in cash from her.

Deputy Public Prosecutor Arfa Anchal Khan and Inspector Mohamad Hamidi Mohamad Hamzah prosecuted the cases.
