Man charged with murdering son, 9
Shim, who was wheeled into the courtroom before Magistrate Dzul Elmy Yunus, is charged under Section 302 of the Penal Code.
Kota Kinabalu: A 45-year-old man was charged in the Magistrate’s Court Tuesday with murdering his nine-year-old son, here, recently.

Shim Jia Yeong, unemployed, was accused of committing the offence against one Ayden Shim on Dec 14, at 1.40pm, in a house at Taman Sunny Garden.

Shim, who was wheeled into the courtroom before Magistrate Dzul Elmy Yunus, is charged under Section 302 of the Penal Code.

The charge carries either the death penalty or imprisonment of not less than 30 years but not exceeding 40 years, and if not sentenced to death, shall be punished with whipping of not less than 12 strokes for male convicts below 50 years of age, on conviction.

No plea was recorded from Shim, as his plea would only be recorded in the High Court once his case is transferred there.

Prosecuting officer Inspector Mohamad Hamidi Mohamad Hamzah applied for the accused to be referred to Hospital Mesra Bukit Padang for mental observation and a psychological report.

Dzul fixed Feb 25, next year, for mention and ordered the accused to be further remanded.

Meanwhile, a 33-year-old man was fined RM1,000 or three months’ jail for failing to produce identification documents.

Frinthiroy Salapang pleaded guilty to committing the offence at 4.30pm on Dec 18 by the roadside along Jalan Rugading, next to the SBH Kibing Solar factory.

Frinthiroy failed to produce his identity card or any temporary identification document when requested by Corporal Alphonius Albert.

The offence under Regulation 25(1)(n) of the National Registration Regulations 1990 is punishable with imprisonment of up to three years or a fine of up to RM20,000.

The court heard from the prosecution that a police patrol team stopped the Frinthiroy along Jalan Rugading and asked him to produce his identity card or identification documents, but he failed to do so.

Frinthiroy, unrepresented, requested a lenient sentence.
