Kota Kinabalu: A 28-year-old man was fined RM4,000 or five months’ jail by the Magistrate’s Court here for helping to dispose of a stolen mobile phone.
Md Qhairil Md Aksam pleaded guilty before Magistrate Dzul Elmy Yunus to assisting in the disposal of a stolen red Oppo A5S mobile phone belonging to the Matahari clothing store at 1Borneo Mall, here, at 10.30am, on Oct 21, this year.
The offence, under Section 414 of the Penal Code, carries a jail term of up to three years, or a fine, or both.
The court heard from Inspector Mohamad Hamidi Mohamad Hamzah that a police report was lodged after the shop, owned by the complainant’s employer, was found broken into at about 11.38am that day.
Investigations revealed that a man had entered the shop by prying open the back door, damaging its roller shutter before ransacking the cashier counter.
The man took cash from the counter drawer and two mobile phones belonging to the shop before fleeing around midnight on Oct 21.
He later discarded both phones near the scene, in a roadside drain area close to One Borneo Hypermall.
Police later recovered one of the stolen phones, the red Oppo A5S, from the location.
Investigations concluded that Md Qhairil had helped dispose of the stolen phone.
In another case, a 31-year-old man was fined RM1,500 or three months’ jail by the same court for gambling in a public place.
Wong Meng Siong pleaded guilty to committing the offence at 6.40pm on Oct 25, in a premises at Inanam Plaza, Inanam.
He was charged under Section 7(2) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000 or up to six months’ jail, or both, upon conviction.
According to the prosecution, a police team raided the premises following a tip-off.
During the raid, police found 10 people, nine men and a woman, engaged in ‘Bola Jalan’ betting.
Investigations confirmed that Wong had taken part in the illegal betting activity.
Among the items confiscated were mixed cash totalling RM1,130.
Meanwhile, a man claimed trial to having stolen properties.
Abdul Rashid pleaded not guilty to keeping a stolen Perodua Axia and its key belonging to one Saidatul Ana, on Oct 22, this year, at 6pm near an empty building at Taman Limauan, Kinarut.
The charge is framed under Section 411 of the Penal Code.
The prosecution proposed bail at RM4,000 while the accused, who was not represented, requested a lower bail amount.
The court fixed Dec 11 for pre-trial case management and released the accused on a bail of RM2,500 in two sureties.
The accused was also ordered to report to the police station once in fortnight.
