KOTA KINABALU: A 24-year-old lorry conductor was sentenced to 15 years’ imprisonment and 10 strokes of the cane for raping his biological sister.
The accused pleaded guilty to a charge under Section 376(3) of the Penal Code involving an incident in December 2021, though the court heard he had abused the victim since she was 12.
The prosecution successfully argued for a deterrent sentence, highlighting the "grotesque" betrayal of a sibling bond and the irreversible psychological trauma inflicted on the victim.
The court heard that during the final assault, the man threatened to harm their parents and evict the victim to force compliance.
Despite the man’s plea for leniency to pursue his future ambitions, Judge Zaini Fishir ruled that the gravity of the crime necessitated a harsh punishment to serve as a public warning.
