Man gets jail for attempted assault
The offence under Section 324 of the Penal Code, read together with Section 511 of the same Code for attempt, carries a jail term of up to 10 years, or a fine, or whipping, or any two of the punishments, with the imprisonment not exceeding half of the maximum term, on conviction.
Kota Kinabalu: A 31-year-old was sentenced to six months’ jail by the Magistrates’ Court here on Tuesday for attempting to assault another man with a metal parking barrier.

Tarif Aziz pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to attempting to cause injury to one Muhammad Khairuldin Muhammad Nasir, 54, at1.30am on April 10, this year, in front of a hotel in the city.

The court heard from the prosecution, that the victim, a building maintenance worker, was carrying out maintenance work when he was approached by Tarif, who was intoxicated.

Tarif suddenly picked up a metal parking barrier, estimated to weigh about 20kg, and attempted to strike the victim.

The victim managed to dodge the blow but sustained injuries while trying to avoid being hit.

Members of the public intervened and managed to restrain Tariff, who was later detained while still in a drunken state.

In another case, four men were fined RM1,700 or three months jail each for assaulting a man.

Md Zulhafiez Shah Reeza, 26, Andre Azroy Jesol, 31, Md Iqwan Hafizth Md Yazid, 29, and Md Alif Ferhans, 23, pleaded guilty before Magistrate Marilyn Kelvin to jointly causing injury to one Lee Yee Hoow at 4.40am on Dec 25, 2025, outside the Birds Club in Bundusan, Penampang.

The offence under Section 323 of the Penal Code carries a jail term of up to one year, or a fine of up to RM2,000, or both, on conviction.

The prosecution informed the court that the victim lodged a police report at the Penampang Police Station at 5.38pm the same day, claiming he was assaulted by a group of men who were also patrons at the club where he worked.

The incident was triggered after the victim threw ice towards the group, following which he was assaulted by several men.

Police investigations found the victim sustained injuries, including a cut on his right eyebrow, bruising on his right elbow and swelling on his forehead.

All the four men were later arrested following the report.
