Kota Kinabalu: An undocumented labourer was sentenced to four months’ jail by the Magistrate’s Court for criminal intimidation.
Aldimar Rahim, 33, pleaded guilty before Magistrate Dzul Elmy Yunus threatening one Liza Abdullah, 27, causing her fear, on March 27, this year, at 10pm, at a house in Taman Rimba, Bandar Sierra, Manggatal.
The charge under Section 506 of the Penal Code carries a jail term of up to seven years or fine or both on coviction.
The court was told by the prosecution that the complainant had questioned Aldimar for returning home late, which led to a quarrel.
Aldimar then became angry and choked her.
Similar incidents had occurred previously, where Aldimar had slapped, strangled and threatened to kill the complainant and also have threatened to force her into prostitution.
Aldimar, who was unrepresented, pleaded for leniency, saying he had a child and a grandmother under his care.
Inspector Mohamad Hamidi Mohamad Hamzah prosecuting urged the court to impose a deterrent sentence and to refer Aldimar to the Immigration Department.
The court sentenced Aldimar to four months’ imprisonment and ordered that the sentence run from the date of his arrest.
He was also ordered to be referred to the Immigration Department after completing his sentence.
In a separate case, a kitchen helper was jailed for having stolen property.
Mohd Iswadi Medi pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to having stolen property belonging to Himani Abdullah, comprising two mobile phones and a piggy bank, on April 2, this year, at 4.30pm, at a house in Taman Jaya Diri, Sepanggar.
The charge under Section 411 of the Penal Code, carries a jail term of up to five years or fine or both on conviction.
Deputy Public Prosecutor Arfa Anchal Khan said that on March 29, the complainant discovered her home had been broken into while she was away, with a back door forced open and a bedroom window smashed.
Several items were reported missing, including a laptop, mobile phones, cash, an ear pod and a school bag.
Iswadi was arrested following police intelligence on April 2 and the stolen items were recovered in his possession.
Duty counsel Carmen Khoo, representing Iswadi, appealed for a lenient sentence, citing his employment as a kitchen helper, remorse, and that he has three children and a mother to support.
The court ordered him to serve his sentence from the date of his arrest.
