The facts of the case, presented by the prosecution stated that investigations were initiated following a report lodged by a complainant, who claimed to have been deceived by Nur in relation to a Mount Kinabalu climbing activity scheduled for May 30, 2025.

The complainant had paid RM950 in cash to Nur at Poring Hot Spring, Ranau, on Nov 30, 2024, after being offered participation in the activity.

The sum was later refunded, but investigations proceeded following instructions from the Deputy Public Prosecutor on the document received by the complainant and witnesses.

Further investigations revealed that a witness, one Sylvrina S. Motiung, received the invoice from Nur on Nov 18, 2025, in Penampang.

Checks by the investigating officer confirmed that the document was false and was never issued by any authorised agency managing Mount Kinabalu climbing permits.

Based on the overall witness testimonies, documents obtained, and Nur’s failure to arrange the Mount Kinabalu climb or provide a reasonable explanation, investigations revealed elements of fraud involving the use of a forged document by Nur.
