Duo fined for ignoring Consumer Tribunal orders
Both offences were framed under Section 117(1) of the Consumer Protection Act 1999, which provides a fine of up to RM10,000, imprisonment of up to two years, or both on conviction.
Kota Kinabalu: Two men were each fined RM1,500 or two months’ jail by the Magistrate’s Court here for failing to comply with awards issued by the Consumer Claims Tribunal.

Mohd Khairul Afis, 31, and Mohd Syafiq Kassim, 27, pleaded guilty separately before Magistrate Dzul Elmy Yunus to the charges against them.

Khairul was charged with failing to comply with a Consumer Claims Tribunal award dated Sept 23, 2025 which ordered him to refund RM17,500 to Ganados Estrella on Oct 7, 2025 at Sanny Automobile, Bundusan Commercial Centre, Penampang

According to the prosecution in the facts of the case, Khairul was ordered by the tribunal to settle the payment to the claimant within 14 days from the date the award was issued but failed to do so after the award was served on him.

The claimant later on Oct 7, 2025 lodged a complaint with the Ministry of Domestic Trade and Cost of Living over the failure to comply with the tribunal’s decision.

In a similar case, Syafiq was found to have failed to comply with a tribunal award dated Feb 19, 2025, which ordered him to pay RM16,350.50 to claimant Joshua Siaw.

The offence was committed on June 17, 2025 at HD Furnishing Enterprise, Damai Plaza.

The court heard from the prosecution that the tribunal had ordered Syafiq to refund the amount to the claimant within 14 days from the date the award was issued.

However, he failed to do so after the award was served on him. 

The claimant subsequently lodged a complaint with the Ministry of Domestic Trade and Cost of Living on June 4, 2025 regarding the non-compliance, prompting enforcement action against the accused.
