Kota Kinabalu: A husband and wife were fined a total of RM4,500 for having and selling unregistered products as well as cosmetics without labels.
Sessions Court Judge Amir Shah Amir Hassan handed the sentence to Mohd Ainal Salasa, 39, and Catrina Majid, 32, after the couple pleaded guilty separately, to the charges against them on Thursday.
Mohd Ainal faces two charges, while Catrina has one; the court ordered each charge to carry a fine of RM1,500 or one month’s jail.
On the first count, Mohd Ainal was found in possession of four types of products that were not registered with the Ministry of Health (MOH), including three bottles of Brilliant Rejuv Topical Solution (toner), six boxes of Qiansoto Breast Massage Oil, two bottles of America Superman, and one box of Tissue Magic.
He committed the offence at 11.51am on July 4, 2024, at Putih Collection in Pekan Lama, Jalan Bunga Raya, Papar.
The offence, under Regulation 7(1)(a) of the Control of Drugs and Cosmetics Regulations 1984, carries a jail term of up to three years, a fine of up to RM50,000, or both, on conviction.
On the second count, he had eight cosmetics without notifications, including Armpit Whitening Cream, AHA Whitening Soal, Perfect Skin Lady Konjic Hya, Yanko Whitening, and Yanko Anti-Spot, at the same place and time.
For Catrina, she had a single unregistered product, a bottle of Brilliant Rejuv Topical Solution (toner), which she sold to a man at the same place and time.
Prosecuting Officer Onng Chi San from the Pharmacy Department appeared for the prosecution.
