Kota Kinabalu: A 39-year-old man was jailed for 12 months and fined RM2,000, or a further six months in default, by the Magistrate’s Court here on Tuesday for smashing the windows and furniture of his mother’s house with a machete.
Daniel Aaron Sahamin admitted before Magistrate Marilyn Kelvin to damaging the windows and furniture of a house in Kg Babah, Penampang, on Feb 25 at 10am, using the weapon, causing losses of RM11,447 to the complainant, Stephane @ Betty.
The charge under Section 427 of the Penal Code carries a jail term of between one and five years, or a fine, or both, on conviction.
Prosecuting officer Inspector Yusdi Basri told the court that Daniel became aggressive on the said day and smashed household items while holding a machete to threaten the complainant, who lodged a police report for safety reasons.
Investigations revealed that Daniel acted out of anger after the complainant objected to him befriending and bringing another woman home, despite being married with a child.
Meanwhile, Daniel is also facing another charge of threatening to cause the complainant’s death.
He pleaded not guilty to the charge, allegedly committed at the same place and time. The charge under Section 506 of the Penal Code carries a sentence of up to two years’ imprisonment, or a fine, or both, on conviction.
The Magistrate fixed April 14 for pre-trial case management and released the accused on bail of RM1,600 in two sureties, with additional conditions not to tamper with the complainant or the prosecution’s witnesses.
Daniel was represented by counsel Lim Ming Zoong, who requested a lenient sentence for the first count and a lower bail amount for the second charge.
