Kota Kinabalu: A private car driver and disabled person card holder was discharged without acquittal from a charge of physically sexually harassing a kindergarten pupil six years ago.
Sessions Court Judge Amir Shah Amir Hassan granted the discharge following a request by the prosecution on Tuesday.
The prosecution informed the court that the complainant had lodged a police report to withdraw the earlier report against Noredi Abu Bakar, 53.
The complainant, present in court, confirmed he had submitted another police report to withdraw the previous one.
Counsel Muhamad Amirul Amin, representing Noredi, raised no objection to the prosecution’s application.
He had previously informed the court on May 16, 2025, that Noredi is an OKU card holder.
Noredi was accused of kissing the six-year-old girl’s face, touching her thighs, and engaging in sexual acts inside a car while transporting her from a kindergarten to a house in Tuaran in early September 2020.
The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, carries a jail term of up to 20 years and whipping, on conviction.
The court also ordered Noredi’s bail deposit to be refunded. Deputy Public Prosecutor Bryan Francis represented the prosecution.
