Man charged with raping woman with Down syndrome
The man is charged under Section 376(2)(k) of the Penal Code, which carries a jail term of between 10 years and 30 years and whipping on conviction.
Kota Kinabalu: A 25-year-old man was charged in the Sessions Court here with raping a 21-year-old woman with Down syndrome.

The man, who appeared before Judge Hurman Hussain pleaded not guilty after the charge was read out.

The accused allegedly committed the crime on Nov 19, 2023, between 9pm and 9.15pm at a house in a village in Ranau.

The man is charged under Section 376(2)(k) of the Penal Code, which carries a jail term of between 10 years and 30 years and whipping on conviction.

Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir prosecuting, objected bail citing that the accused lives very close to the alleged victim’s residence.

The court fixed 27 April for pre-trial case management.

The accused was ordered to be further remanded pending the date. 

In another court, 10 people were penalised at the Magistrate’s Court for committing drugs related offences.

Magdar Sulaiman admitted to having 0.34gm of ketamine, while Nasrulah Taib, Md Helmi Arshad, Julni Jalina and Apolo Naris pleaded guilty to having syabu weighing between 0.02gm and 0.07gm at separate locations here between Sept 2, 2025 and Dec 20, the same year.

Magdar was sentenced to eight months jail by Magistrate Dzul Elmy Yunus while the rest were handed seven months each.

The five were each charged under Section 12 (2) of the Dangerous Drug Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both on conviction.

Meanwhile, Juli, Apolo and another five people Jaham Ismail, Paul Saluang, Alkamar Hajirun, Jasmin Tianok and Tuma Bin pleaded guilty to taking syabu and amphetamine.

They were jailed five months each.

They were charged under Section 15(1) of the Dangerous Drug Act, which provides for a fine of up to RM5,000 or up to two years jail on conviction.
