Kota Kinabalu: An unemployed man was sentenced to 11 months in prison by the Magistrate’s Court here on Tuesday for criminal trespass.
Abdul Latip Umar pleaded guilty before Magistrate Marilyn Kelvin to entering a rented room occupied by one Shahrizan Nasrin at 2.30pm on October 16, 2025, above a coffee shop in Donggongon, Penampang, without permission.
The court found Latip guilty under Section 448 of the Penal Code, which provides for imprisonment of up to three years, a fine of up to RM5,000, or both, on conviction.
Earlier, the prosecution informed the court that on the specified day, the complainant noticed an unknown man acting suspiciously inside his son’s room. The complainant contacted his son, who rushed home and attempted to detain the intruder, later identified as Latip.
A struggle ensued when Latip attempted to flee, but he was restrained and detained. The police arrived shortly after and rearrested Latip.
A small amount of coins, believed to be stolen property, was recovered from him, the court heard.
Latip was ordered to serve the sentence from the date of his arrest.
In a separate case, another man was fined RM6,000 or jailed 11 months for possessing a stolen Coach sling bag.
Salesman Marzaly Matsun, 41, pleaded guilty to removing the bag, which belonged to one Ken Chee Cheong, on January 15 this year at 2am in Taman Kemajuan, Likas.
The prosecution informed the court that the stolen bag was among several items missing from the complainant’s house when it was broken into on January 1.
Police investigations, following a report lodged by the complainant, led to Marzaly’s arrest on February 11.
Marzaly was charged under Section 414 of the Penal Code, which carries a jail term of between six months and seven years, along with a possible fine, on conviction.
Unrepresented, Marzaly pleaded for leniency, telling the court that he had children to support and asked not to be sent to jail. Inspector Yusdi Basri, prosecuting, applied for a deterrent sentence.
