Jobless man jailed: Armed grab
The offence was framed under Section 395 of the Penal Code read together with Section 397, which carries a jail term of up to 20 years and whipping upon conviction.
Kota Kinabalu: An unemployed man was sentenced to six years’ jail and ordered to be given one stroke of the cane by the Sessions Court here on Friday for armed gang robbery.

Mohd Shah Fazlee Ali Khan, 31, pleaded guilty before Judge Marlina Ibrahim to robbing Marycli Hatamosa Liquinan of a Huawei mobile phone, an Apple iPad, her passport, and RM735 in cash at about 5pm on Aug 10, 2025, near a 24-hour 7-Eleven convenience store at Beverly Hills, Jalan Bundusan, Penampang.

The charge stated that Shah committed the crime while armed with a knife, along with an accomplice.

Shah pleaded guilty on Friday, which marked the commencement of his trial.

Deputy Public Prosecutor DK Afiqah Alya PG Johari, in presenting the facts of the case, informed the court that on the said day, the complainant was near the 24-hour 7-Eleven store at Beverly Hills when she was approached by an individual, later identified as Shah.

He pointed a knife at her and snatched her sling bag before fleeing the scene. The sling bag contained her Huawei mobile phone, Apple iPad, passport, and RM735 in cash.

Shah then ran to a Perodua Axia, which was waiting nearby and driven by his accomplice, before the vehicle sped off from the scene.

The complainant was able to recognise Shah as the man who robbed her, as he was not wearing a face mask at the time. 

An eyewitness supported the complainant’s account.

During investigations, police traced the vehicle and arrested Shah and his accomplice. 

The complainant later identified Shah as the person who robbed her while armed with a knife and also identified her passport, Huawei mobile phone, and Apple iPad recovered by police.

Unrepresented, Shah requested a lenient sentence, while the prosecution applied for a deterrent sentence.

The court ordered Shah to serve the sentence from the date of his arrest on Aug 20, 2025.
