Boss and staff are charged over fight
Both offences under Section 323 of the Penal Code carry a penalty of up to one year’s jail, or a fine of up to RM2,000, or both, on conviction.
Kota Kinabalu:  A shop owner and his employee were separately charged at the Magistrates’ Court here with assaulting each other at their workplace three months ago.

Jonathan Wong Kim Sin, 36, the employer, and Sim Lim Pong, 20, the employee, appeared before Magistrates Dzul Elmy Yunus and Wan Farrah Farriza Wan Ghazali, respectively, and both claimed trial to the charges.

Wong is accused of intentionally causing hurt to Sim at about 12.30pm on Aug 26, at a souvenir shop in Gaya Street, here.

Sim, meanwhile, is accused of intentionally causing hurt to Wong at the same time and place.

Dzul fixed Jan 28, next year, for pre-trial case management (PTCM) of Wong’s case and released him on bail of RM1,700, while Sim’s PTCM was set on  Jan 26, next year.

Meanwhile, a 32-year-old man, who pleaded guilty to causing fear to a woman, was released on a one-year good behaviour bond of RM1,000, with RM1,000 undeposited.

Magistrate Dzul made the order against Andrew Thien after he admitted to committing the offence against one Normalina Mappiati, at 7.20pm on Sept 21, this year, at Taman Kendara 1, near here.

The charge, under Section 8(1)(e) of the Minor Offences Ordinance (Cap 80) of Sabah, provides a fine of up to RM25 on conviction.

Earlier, the court heard from the prosecution that Normalina was inside her home when Thien, her neighbour from the opposite unit, aggressively came to her door.

Thien repeatedly banged loudly on the door while holding an object resembling a knife, causing the complainant to fear for her safety.

The complainant immediately held the door shut and contacted the police.

She also stated that similar incidents had occurred before, although no previous reports were made.

During mitigation, Thien told the court that he needed to look after his mother and that he was also unwell.
