Man jailed for retaining stolen motorcycle
The offence under Section 411 of the Penal Code carries between six months and five years’ jail, and a possible fine, on conviction.
Kota Kinabalu: A 30-year-old man was jailed 10 months by the Magistrate’s Court for retaining a stolen motorcycle in Likas.

Azir Madayah pleaded guilty before Magistrate Marilyn Kelvin to retaining a stolen blue Honda RS-X motorcycle belonging to one Gerald Bintang at 2.45am, on Oct 28, this year, at the roadside along Jalan Haiwan, Kampung Likas.

The court heard from the prosecution that on Aug 26, the complainant reported that his motorcycle had disappeared from Inanam Point around 7am.

Police later intercepted Azir on Sept 23, riding the same machine with mismatched registration details, leading to his arrest.

In another case, a 28-year-old man was fined RM2,000 or jailed seven months for assisting in disposing of stolen property.

Insani Mohd Isan pleaded guilty to moving three Total brand stolen batteries at 3.30pm on Nov 5, this year, at house in Kg Suang Parai, Alamesra, 

The offence is punishable under Section 414 of the Penal Code with up to seven years’ jail, a fine, or both, on conviction.

The prosecution informed the court that a report lodged on Oct 27, revealed that four batteries had been stolen from Bestmart in Lido. 

Insani was arrested on Nov 4 and acting on his lead, police recovered three stolen batteries at the location the next day. 

The complainant confirmed the items based on matching barcodes.

Meanwhile, a 34-year-old man was jailed 10 weeks and fined RM1,000 or a further four weeks’ jail for theft.

Yassin Md Nur pleaded guilty before Magistrate Dzul Elmy Yunus to stealing two bottles of Ubermen perfume (100ml) at 10.39am on Nov 13 at Bataras Marketplace, Jalan Pantai, here.

The offence under Section 380 of the Penal Code carries up to 10 years’ jail and a possible fine, with heavier penalties for repeat offenders, on conviction.

The court heard from the prosecution that CCTV captured Yassin taking the perfume and walking out without paying before being detained by a security guard. 

In the same court, a 32-year-old man claimed trial to trespassing into his neighbour’s rented room.

Ricky Boan was accused of committing the offence on the first floor of Inanam Taipan, Inanam, on Nov 13, at 2am.

The charge is framed under Section 448 of the Penal Code.

He was released on a bail of RM2,500 in two sureties pending pre-trial case management on Jan 20.
