Kota Kinabalu: A 42-year-old undocumented Filipino was tentatively charged at the Magistrate’s Court, here, with trafficking 1,014 gm of syabu.
No plea was recorded from Arizan Raidi when the charge was read before Magistrate Marilyn Kelvin.
Arizan is accused of committing the offence on Oct 20, this year, at 11.30am, at the roadside near the taxi stand area next to a hut in front of the Promenade Hotel, here.
The charge, framed under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, carries the mandatory death penalty or life imprisonment, along with a minimum of 15 strokes of the cane, upon conviction.
The court set Jan 12, next year for mention, pending the chemist’s report.
Arizan was ordered to remain in custody as the offence is non-bailable.
In another case, a 24-year-old woman was fined RM1,600 or one month jail for having gambling paraphernalia.
Norhafizah Osin pleaded guilty to having two lottery tickets without a licence on Aug 8, this year, at a premises in the Beverly Hills area, in Penampang.
The charge under Section 9(1) of the Common Gaming Houses Act 1953, provides for a fine of up to RM5,000 or a jail term of up to six months or both, on conviction.
The court heard from the prosecution that Norhafizah was arrested by police for being involved in illegal gambling activity in the said area.
The police also seized RM204 in cash from her.
Duty counsel Lim Ming Zoong representing Norhafizah, requested a lower fine.
The prosecution applied for a deterrent sentence.
The court also granted the prosecution’s application for the seized money to be forfeited as government revenue.
