Kota Kinabalu: A 43-year-old chef was on Friday discharged and acquitted by the Magistrate’s Court here of dangerous driving, which led to the death of a pedestrian six years ago.
Magistrate Wan Farrah Farriza Wan Ghazali made the ruling in favour of Sim Yun Kong, after concluding that the defence had raised reasonable doubt by the end of the trial.
The court ordered Sim to be discharged and acquitted.
Sim was charged with driving a car dangerously, causing the death of pedestrian Klaus Friedrich Walter Knolke on March 10, 2020, at 7.38pm, along Jalan Tun Fuad Stephens, hee.
The offence, under Section 41(1) of the Road Transport Act 1987, carries a potential jail sentence of between two and 10 years and a fine of between RM5,000 and RM20,000, on conviction.
During the trial, the prosecution called seven witnesses, while Sim was the only witness for the defense.
The prosecution team was led by Insp Mohamad Khairul Nizam Mokhtar and Insp Irianshah Bakar. Sim was represented by counsel Ariel Dasan and Dominic Chew.
