Kota Kinabalu: Two men charged with robbing another man of RM8,000 will go to trial after their guilty pleas were rejected when they disputed the facts of the case.
Sessions Court Judge Hurman Hussain rejected the pleas of Zulkifli Said, 47, and Ahmad Khuzairi Zulkifli, 25, who had earlier pleaded guilty to the charge against them.
However, when the facts of the case were read out, both Zulkifli and Ahmad disputed parts of the prosecution’s version.
The duo are accused of robbing Teo Haw Chung, 32, of RM8,000 at about 5am on Feb 11 this year at Kedai Supply Food of Pack in Jalan Siren, Tanjung Aru, near here.
The offence under Section 395 of the Penal Code carries a jail term of up to 20 years and whipping upon conviction.
During proceedings, Zulkifli admitted to the charge and pleaded for leniency, saying he suffers from diabetes and has two children to support following his divorce.
However, he later claimed that he had only taken the bag and left the scene, prompting the court to reject his plea.
Zulkifli also told the court that he had merely been asked to retrieve documents from inside the bag.
Ahmad similarly admitted to the charge but informed the court that the facts of the case were untrue.
The court fixed April 27 for pre-trial case management and ordered both men to be further remanded pending that date.
Zulkifli and Ahmad were advised to engage counsel to represent them.
Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir appeared for the prosecution.
