Ranau shop owner fined for unregistered cosmetics
The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984, carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.
Kota Kinabalu: A shop owner was fined a total of RM2,000 for two counts of having unregistered products and cosmetics without notifications.

Mohammed Faizal Asarafullasha pleaded guilty before Sessions Court Judge Hurman Hussain, to two counts against Mohammed on Wednesday.

On the first count, Mohammed was fined RM1,000 in default 30 day’s jail for having four products which were not registered with the Ministry of Health at 11.55am on June 12, 2024 at the Razida Trading in Sedco building in Kundasang, Ranau.

The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984, carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.

On the second count, Mohammed was ordered to pay another RM1,000 fine or spend 30 day’s jail for having four cosmetics without notifications at the same place and time.

Meanwhile, a shop assistant was fined RM500 in default fourteen days’ jail for selling two cosmetics without notifications to a man.

Mohd Kadir Ismail admitted to selling the two cosmetics without labels at the same place and time as Mohammed.

During mitigation, both Mohammed and Mohd Kadir asked for leniency.

While, the prosecution urged the court to impose an appropriate sentence as the duo had committed the offence which could risk the public’s health as the products did not registered to the Health Ministry and no labels.

Prosecuting Officer Muhammad Zainal Ariff Ozeman @ Azeman from the Pharmacy Department appeared for the prosecution.
