Trespassing: Man gets 10 months
The charge, under Section 448 of the Penal Code, carries a penalty of up to three years’ jail, a fine of up to RM5,000, or both, on conviction.
Kota Kinabalu: A 29-year-old man was sentenced to 10 months by the Magistrate’s Court for trespassing into a house in Tanjung Aru.

Alif Hussien, 29, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing house trespass into the home of one Yvonne Chin at Lorong Ikan Pepuyu, off Jalan Mat Salleh, at 2.58am on Dec 25, 2024.

The charge, under Section 448 of the Penal Code, carries a penalty of up to three years’ jail, a fine of up to RM5,000, or both, on conviction.

The court heard from the prosecution that the complainant discovered her double-storey bungalow ransacked at 8am the same day and found several valuables missing.

CCTV footage showed a male intruder climbing the fence, getting onto the kitchen roof and entering through an upstairs bathroom window that had no grille. He was seen taking the items and placing them in a handbag before exiting via the same route.

Investigators found 10 fingerprints at the scene, one of which matched Alif’s through the BIOFIS system.

Alif was later arrested at 3am on Feb 26, this year, for his involvement in a cable theft.

The prosecution applied for a deterrent sentence and for it to run consecutively with Alif’s other jail terms for five separate offences.

In a separate case, a woman claimed trial to having RM4,100 in her bank account, which was reasonably suspected to have been dishonestly obtained.

Hadizah Hamilin, 38, allegedly failed to give a satisfactory explanation as to how she acquired the money in her CIMB account at the Bundusan branch at 11.45am, on Feb 13, this year.

The charge, under Section 22A(1) of the Minor Offences Ordinance, carries a fine of up to RM100, up to three months’ jail, or both.

The court fixed Jan 22 for mention and released the accused on RM800 bail.
