Kota Kinabalu: A 56-year-old food vendor was sentenced to 11 months’ jail by the Magistrate’s Court here for misappropriation of property amounting to RM7,500.
Jakariah Janit, who appeared before Magistrate Marilyn Kelvin, pleaded guilty to fraudulently misusing RM7,500 cash belonging to one Mohd Rafaie Sitong between Dec 28, 2023 and Jan 3, 2024 at Maybank Kg Air here.
He changed his plea to guilty to the charge under Section 403 of the Penal Code, to which he had initially claimed trial on Aug 30 last year.
The charge carries a jail term of between six months and five years and whipping and liability of a fine on conviction.
The facts of the case presented by the prosecution stated that on Dec 28, 2023, at 9am, the complainant met Jakariah at a restaurant in Inanam to discuss an offer to purchase several land lots said to be in Danau Kota, Alamesra.
Jakariah offered the lots at RM500 each.
Over the period from Dec 28, 2023 to Jan 3, 2024, the complainant paid RM7,500 for five lots and transferred the money into Jakariah’s Maybank account.
The complainant later could not contact him about the land and lodged a police report on March 26, 2024.
Police investigations found that Jakariah had submitted applications for the reserve land at the Lands and Surveys Department, but all the applications were cancelled.
Officers also confirmed that no payment is required for such applications and that Jakariah had no right to apply for the reserve land.
Meanwhile, a warrant of arrest was issued against a 32-year-old man charged with assaulting a woman after he failed to appear in court for the pre-trial case management of his case.
Magistrate Wan Farrah Farriza Wan Ghazali fixed Jan 20, next year, for the review of the warrant of Fitri Hazrulneezam Duhanein.
Fitri allegedly committed the offence against one Sue Rachelle on Sept 23, this year, at 8.30pm, in Kg Puun Tunoh, Penampang.
He claimed trial to the charge under Section 323 of the Penal Code on Oct 1, this year, and was released on a court bail.
