Kota Kinabalu: A 38-year-old man was sentenced to seven years in jail and three strokes of the cane for repeatedly consuming syabu.
Sessions Court Judge Zaini Fishir handed down the punishment after Aziz Adi was found guilty of being a repeat offender under drug-related offences.
Aziz committed the offence at 5.30pm on Sept 9 this year after his urine was tested positive for drug at the police station here.
He had one previous conviction record under Section 39C(1) of the Dangerous Drugs Act (DDA).
The offence under Section 39C(2) of the DDA and punishable under Section 39B(1) of the DDA provides for a jail term of between seven and 13 years, and whipping between three and six lashes, on conviction.
The court ordered Aziz to serve the jail sentence from the date of his arrest and placed under police supervision for two years after serving the jail sentence.
In mitigation, Aziz who was not represented asked for leniency.
However, Deputy Public Prosecutor DK Afiqah Alya PG Johari urged the court to impose a heavy sentence as Aziz had repeatedly taken the drug.
