Kota Kinabalu: An Assistant Information Officer was charged with 10 counts of using his position to choose his brother’s company to supply food and drinks for several programmes under his department.
Sharif Ahmad Shah Sh. Mundui, 49, pleaded not guilty before Sessions Court Judge Abu Bakar Manat, after the charges were read to him on Tuesday.
On the first to tenth counts, Sharif Ahmad, who was attached to the Kota Marudu District Information Office, is accused of abusing his position by appointing Syarikat Sutra Gemilang Enterprise which belonged to his brother Sharif Idrus Sarif Mundoi @ Habib Ali to supply food and drinks for various programmes held in Kota Marudu.
The charges stated that Sharif Ahmad allegedly committed the offences by asking a clerk to invite the company as the supplier for the various programmes and due to Sharif Ahamd’s act, the company was appointed to supply food and drinks valued at RM43,200 for the various programmes.
The offences allegedly took place between May and October 2019.
The charge was framed under Section 23 (1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 and punishable under Section 24 (1) of the same Act, which carries a jail term of 20 years and a fine of five times the bribe amount or RM10,000, whichever is higher, on conviction.
The court fixed Oct 27 for pre-trial case management and released Sharif Ahmad on a bail of RM20,000 with RM8,000 deposited in a local surety.
Sharif Ahmad was also ordered to report to the MACC office once in two months and his passport, if any, to be kept by the court until the disposal of his case.
The court also warned Sharif Ahmad to not tamper with prosecution witnesses.
Deputy Public Prosecutor Nurul Izzati Sapifee appeared for the prosecution while Sharif Ahmad was not represented.
