Kota Kinabalu: Two men were fined a total of RM3,800 by the Magistrate’s Court here for assaulting a man at an apartment in Manggatal.
Md Amirul Asyraf, 22, and Hasbullah Jupri, 25, pleaded guilty before Magistrate Marilyn Kelvin to jointly voluntarily causing hurt to one Md Zaidani Zidane Nasrun in a unit at Universiti Apartment 1, Manggatal, at 4.45am on Jan 15.
The court ordered Amirul to pay a fine of RM2,000 or serve six months’ jail in default, while Hasbullah was fined RM1,800 or six months’ jail in default.
The offence under Section 323 of the Penal Code read together with Section 34 of the same Code carries a jail term of up to one year, a fine of up to RM2,000, or both, on conviction.
The prosecution informed the court that on the said day, the complainant was sleeping in the living room of the apartment when he was awakened by Amirul, who accused him of disturbing his girlfriend.
The complainant denied the allegation but Amirul punched him in the head.
Hasbullah, who was present at the scene, also joined in the assault.
Investigations revealed that both Amirul and Hasbullah had long been unhappy with the complainant, who had been staying at the house since December 2025 but allegedly did not help with house chores or pay rent.
The complainant had also refused to leave despite being advised to do so.
The court heard that prior to the incident, the two men had consumed alcohol while partying at an entertainment outlet in Penampang and were intoxicated at the time.
As a result of the assault, the complainant suffered pain to his head and body, as well as a cut on his lip and swelling on his forehead.
An eyewitness, who was at the scene, saw both Amirul and Hasbullah punching the complainant with their hands.
In another case, two women were fined RM1,200 or two months each for engaging in gambling activities.
Prisca and Nursila pleaded guilty separately before Magistrate Dzul Elmy Yunus to committing the offences in Penampang.
Prisca was found to have five pieces of illegal lottery tickets on Nov 24, 2025 while Nursila was found to be involved in an online gambling activity on Dec 18, the same year.
Both Prisca and Nursila, who were not represented, requested a lower fine while the prosecution applied a deterrent sentence.
Prisca was charged under Section 9(1) of the Common Gaming Houses Act 1953 while Nursila was charged under Section 7(2) of the same Act, which each provides for a fine of up to RM5,000 or a jail term of up to six months or both on conviction.
Inspectors Yusdi Basri and Mohamad Hamidi Mohamad Hamzah prosecuted.
