Filipino illegal  jailed for disturbing woman’s modesty
Win was charged under Section 509 of the Penal Code, which carries a maximum penalty of five years’ imprisonment, a fine, or both, on conviction.
Kota Kinabalu: A 19-year-old Filipino illegal was jailed 17 months by the Magistrate’s Court, here, for disturbing the modesty of a woman in a public toilet.

Win Sharun pleaded guilty before Magistrate Marilyn Kelvin to intentionally insult the modesty of a 33-year-old woman, with the intent to outrage her modesty on Jan 24, at 10.25am in the women’s restroom at the Tionghua Commerce and Industry Hall, here.

Win was charged under Section 509 of the Penal Code, which carries a maximum penalty of five years’ imprisonment, a fine, or both, on conviction.

Inspector Yusdi Basri, prosecuting, told the court that the complainant discovered Win inside the women’s toilet with the intent to peep at other women.

The complainant immediately left the toilet and lodged a police report for her safety and to prevent further incidents.

Win was identified and arrested the same day. A police line-up confirmed the complainant’s identification. 

During mitigation, Win, who was unrepresented, only shook his head when the court asked if he had any appeal before sentencing.

­Inspector Yusdi applied a deterrent sentence, and applied to refer Win to the Immigration Department as he is undocumented.

Magistrate Marilyn ordered Win to serve the sentence from the date of his arrest and be handed over to the Immigration Department thereafter.
