Kota Kinabalu: A 30-year-old man was fined RM4,000 or eight months’ jail by the Magistrate’s Court, here, Wednesday for failing to produce identification documents to the police.
Ahmad Azwan pleaded guilty before Magistrate Marilyn Kelvin to committing the offence on Jan 11, this year, at 6pm, at the roadside of Kg Delima, Alamesra.
Ahmad failed to produce his MyKad when requested by a Corporal. The offence, under Regulation 25(1)(n) of the National Registration Regulations 1990, is punishable with imprisonment of up to three years or a fine of up to RM20,000.
The court heard from the prosecution that a police patrol team stopped Ahmad and asked him to produce his identity card or identification documents, but he failed to do so.
Investigations revealed that Ahmad had a birth certificate but he did not bring it along that day.
Unrepresented, Ahmad requested a lenient sentence, saying he is married with one child and work as contract labourer.
Inspector Yusdi Basri prosecuting, applied a deterrent sentence and for Ahmad to be referred to the Immigration Department for further action as he did not have any identification document.
The court ordered Ahmad to be referred to the Immigration Department after paying the fine or serve the jail term.
In another case, two men were charged with two counts of keeping stolen property.
Lorry driver Jumat Badru, 38, and Marko Narsko pleaded not guilty to both charges before Magistrate Dzul Elmy Yunus.
On the first count, the duo were accused of having in their possession a stolen drive shaft belonging to a shop at about 7.45pm on Jan 6 this year, at a bushy roadside area in the Telipok settlement.
On the second count, they were alleged to have kept three bottles of stolen car lubricant belonging to the same shop at the same place and time. Both charges were framed under Section 411 of the Penal Code read together with Section 34 of the Criminal Procedure Code.
Prosecuting officer Inspector Mohamad Hamidi Mohamad Hamzah, in applying for pre-trial case management, proposed bail of RM4,000 for Jumat and objected to bail for Marko, citing that he had no valid identification document.
Counsel Lim Ming Zoong, representing Jumat, applied for a lower bail amount, citing that his client is married with five children and works as a lorry driver.
The court fixed March 12 for pre-trial case management for the first count and March 16 for the second count. Jumat was released on bail of RM1,700 with two sureties for each count, while Marko was ordered to be further remanded.
