Kota Kinabalu: A 23-year-old man, charged with trafficking 1,278.3gm of syabu, will learn his fate on Feb 11, next year.
High Court Judge Datuk Alexander Siew How Wai fixed the date for Mohd Shahnizar Sukarday after the defence closed its case, having called three witnesses.
Unemployed, Shahnizar allegedly committed the offence at 4pm on Oct 27, 2023 at the parking area of a mosque at Kg Darau, Manggatal.
The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes read with section 34 of the Penal Code.
Seven witnesses were called to testify at the prosecution’s stage.
Shahnizar was represented by counsel Shahlan Jufri while Deputy Public Prosecutor Dacia Jane Romanus appeared for the prosecution.
Meanwhile, a 41-year-old man was sentenced to five months jail by the Magistrate’s Court for keeping stolen properties.
Azlan Samiun pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to keeping a stolen handphone and bank card belonging to one Amran Samin on Oct 11, this year, at 5.20pm, at Bataras hypermart, in Putatan.
He was charged under Section 411 of the Penal Code which carries a jail term of up to five years and liability of a fine or both on conviction.
The court heard from the prosecution that the items were reported stolen from the complainant at the surau (Muslim prayer room) in a hospital here on Oct 6.
In another case, a 38-year-old man was handed with five months’ jail for having housebreaking tools.
Md Yusof Labbang admitted to having an axe and a kitchen knife on Sept 4, this year at 12.30pm, at the roadside of Jalan Tun Fuad Stephen next to the Sabah International Convention Centre (SICC) here.
The charge, under Section 18(e) of the Minor Offences Ordinance, provides for a jail term of up to six months’ jail.
The prosecution told the court that Yusof, seen behaving suspiciously, was arrested after police found the tools in his car parked at the location.
