Man jailed for stolen car, key
The offence under Section 411 of the Penal Code carries a jail term of between six months and five years and liability of a fine, on conviction.
Kota Kinabalu: A 46-year-old man was jailed 15 months by the Magistrate’s Court, here, for having a stolen car and the key.

Abd Rashid Suhaimi pleaded guilty before Magistrate Marilyn Kelvin to having a Perodua Axia and its ignition key, which he had reason to believe were stolen, belonging to one Shaidatulanna Piny at 6pm on Oct 22, this year, beside an abandoned building at Taman Limauan, Kinarut, Papar.

The court heard from the prosecution that earlier that morning, at 7.40am, the complainant discovered that her Perodua Axia, which had been parked at the Block B car park of Pasir Putih Apartment in Putatan, was missing and suspected stolen.

She lodged a police report and stated that the loss was estimated at RM40,000.

Later the same day, at 6pm, a police team detained Abd Rashid at Taman Limauan for his involvement in the case.

Police recovered the vehicle and key from his possession during the arrest.

Duty counsel Lim Ming Zoong representing Abd Rashid, requested leniency, saying among others, that he is a divorcee with two children.

The prosecution applied for a deterrent sentence.

Abd Rashid was ordered to serve the jail sentence from the date of his arrest.

In a separate case, a 24-year-old man claimed trial to voluntarily causing hurt with a weapon.

Niklin Satuah pleaded not guilty to causing injury to a 17-year-old boy at 5am on Dec 7, in front of a 7-Eleven outlet at Inanam Taipan.

He is accused of using a knife, a weapon capable of causing death, during the incident.

The charge is framed under Section 324 of the Penal Code.

The court fixed Jan 27 for mention pending instructions from the Deputy Public Prosecutor’s office after the complainant, who was present in court, informed that he wished to withdraw his earlier report against the accused.

Pending the date, he was released on RM1,000 bail in two sureties.
