Raping sis: Accused changes stand
The offence, under Section 376(3) of the Penal Code, carries a jail term of between eight and 30 years and at least 10 strokes of the cane, upon conviction.
Kota Kinabalu: A 23-year-old lorry attendant who was expected to be sentenced for raping his younger sister changed his plea to not guilty in the Sessions Court here on Tuesday.

Judge Zaini Fishir @ Fisal then fixed Nov 25 for pre-trial case management (PTCM).

The accused is charged with raping his 15 years and four months old sister in December 2021, around 8pm, at a workers’ quarters in Putatan.

The offence, under Section 376(3) of the Penal Code, carries a jail term of between eight and 30 years and at least 10 strokes of the cane, upon conviction.

Deputy Public Prosecutor (DPP) Eugenie Meredith Gilbert appeared for the prosecution, while the accused was unrepresented.

The court ordered the accused to be further remanded pending the disposal of his case.

Meanwhile, in a separate case, a 31-year-old woman accused of criminal breach of trust (CBT) involving RM10,100 was released on bail.

Judge Amir Shah Amir Hassan allowed bail for Nurizzah Fazira Hamzah at RM10,000, with RM3,000 to be deposited and one local surety.

She must also report to the Papar police station once a month, and her passport (if any) will be held by the court.

Nurizzah, who was also initially expected to be sentenced, changed her plea to not guilty on Tuesday. The court fixed Dec 11 for pre-trial case management.

She is accused of committing the offence while working as an account clerk with Good Focus Mortgage Sdn Bhd, a licensed moneylending company, which had entrusted her with the funds.

She allegedly misused the money for her own benefit between June 13 and July 16 this year at the company’s office in Papar.

DPP Bryan Francis appeared for the prosecution, while counsel Gerard Chia represented Nurizzah.
