Cook fined for assaulting niece
The charge, under Section 323 of the Penal Code, carries a jail term of up to one year, or a fine of up to RM2,000, or both, on conviction.
Kota Kinabalu: A 27-year-old cook was fined RM2,000 or eight months’ jail by the Magistrate’s Court here on Tuesday for assaulting his niece.

Ag. Ridzam Ag. Johan pleaded guilty before Magistrate Marilyn Kelvin to voluntarily causing hurt to 19-year-old Marsyilia Abdullah at 9.30pm, on Oct 23 this year, by the roadside along Jalan Bunga Raya, Kepayan.

The charge, under Section 323 of the Penal Code, carries a jail term of up to one year, or a fine of up to RM2,000, or both, on conviction.

The court was informed by Prosecuting Officer Inspector Yusdi Basri that Marsyilia was kicked, slapped and stepped on by Ridzam, who is her uncle, during the incident.

The assault caused her pain in several parts of her body, as well as cuts on her right elbow, palm and ear. 

She later lodged a police report.

Following investigations, police arrested Ridzam on Oct 28, at 10.50am at a restaurant in Central Shopping Plaza. 

Unrepresented Ridzam requested leniency saying that he is married with four children and works as a cook.

In another case, a 35-year-old man pleaded not guilty to causing hurt to his wife.

Dzuffy Rind Shah Matjuni was charged with voluntarily causing hurt to his 33-year-old wife, at their home at Taman Bukit Setia, Sepanggar, at 8.30pm on Oct 27, this year.

The offence, framed under Section 323 of the Penal Code and read together with Section 326A of the same Code, carries a punishment of up to one year’s jail or a fine of up to RM2,000, or both, and up to double the maximum jail term when the offence is committed against a spouse.

The court set the case for pre-trial case management on Jan 7, next year and released Dzuffy on bail of RM2,000 in two sureties with an additional condition not to disturb the victim and other prosecution’s witnesses as well as to report himself to the police station once a month.

The accused was represented by counsel Mohd Al Hafidz Mohd Lokman.
