Kota Kinabalu: An unemployed Filipino was tentatively charged in the Magistrate’s Court here, Friday, with drug trafficking.
Abdul Rashid Sana, 47, was accused of trafficking 55.85gm of syabu at 4pm on June 17 in a house at Kg Sembulan Lama here.
However, no plea was taken from Rashid, who appeared before Magistrate Stephanie Sherron Abbie, after the charge was read out to him.
The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected bail for Rashid as the charge has no provision for bail.
Stephanie fixed Aug 8 for mention and ordered Rashid to be further remanded.
In another case, two people were fined RM1,000 or two weeks’ jail for having gambling paraphernalia. Rafidah Musa, 25, pleaded guilty to having two pieces of lottery tickets illegally at 4.10pm on June 12 in Donggongon, Penampang.
Syamri Suharto, 26, admitted to having five illegal lottery slips at 3.30pm on May 18 in Putatan Baru, Putatan.
The prosecution informed the court that the police conducted an Op Dadu in both areas and detained Rafidah and Syamri for their involvement in illegal lottery businesses. The police also seized a mobile printer and handphone from each Rafidah and Syamri as well as RM22 cash and RM60 cash from them.
The duo were charged under Section 9(1) of the Common Gaming House Act which carries a jail term of up to six months or fine of up to RM3,000, or both, on conviction. Inspector Suzie @ Stephanie Kupit prosecuted.
