Kota Kinabalu: Three Pakistani men were fined RM1,800 or jailed six months each on Friday for assaulting their fellow countryman during a dispute over business matters.
Grocery shop worker Sana Ullah, 46, businessman Latif Ullah, 40, and unemployed Muhammad Dawood, 48, pleaded guilty before Magistrate Dzul Elmy Yunus to jointly causing hurt to one Muhammad Adnan Zairullah Khan at Shayan Enterprise in Telipok, at 8.30am, on May 18, this year.
The charge under Section 323 of the Penal Code read together with Section 34 of the same Code carries a jail term of up to one year, a fine of up to RM2,000, or both, on conviction.
The court heard from the prosecution that the trio had gone to the premises to meet the complainant and the victim to discuss a business-related issue.
During the discussion, a misunderstanding arose and the victim scolded Sana, prompting the three to assault him.
An eyewitness, who was also the complainant, attempted to intervene but was unable to stop the assault.
As a result of the incident, the victim suffered injuries to his head, chest, left arm and left leg.
The trio were arrested on May 21 to assist in the investigation.
Counsel Lim Ming Zoong @ Lawrence, representing the trio, requested for a lenient sentence, saying they have valid passports, were married to local women and had children in Sabah.
Inspector Mohamad Hamidi Mohamad Hamzah, prosecuting, applied a deterrent sentence.
Meanwhile, two people were each fined RM1,000 or three months’ jail for gambling in public places.
Milita Jaharal admitted to gambling at the staircase walkway of Angel Roadside Karaoke Fun Pub in Bandaran Berjaya, at 3.30pm on May 29.
Salam Abang pleaded guilty to gambling at the rear five-foot way beside a shop near Speedmart, Cyber Square, Jalan Kepayan, at 2.25pm, on June 7.
In Milita’s case, the court heard from the prosecution that police conducting surveillance at the location found Milita engaged in online gambling activities.
A check on her mobile phone revealed an application used for online gambling and that police also seized the phone and RM8 cash from her.
In Salam’s case, the prosecution informed the court that police found Salam engaged in online gambling activities during an operation at the location.
A check on his mobile phone revealed an application used for online gambling and that the police also seized the phone and RM50 cash from him.
Further investigations confirmed the applications in their respective handphone were used for online gambling.
Milita and Salam were each charged under Section 7(2) of the Common Gaming Houses Act 1953, which carries a fine of up to RM5,000 or a jail term of up to six months, or both, upon conviction.
The court ordered the seized money to be forfeited as government’s revenue. -
