Kota Kinabalu: Defendants in Consumer Claims Tribunal (TPPM) cases who have lost must comply with the awards made against them or face court action by the Ministry of Domestic Trade and Cost of Living (KPDN).
KPDN Sabah Director Shahril Nizam Shahidin said it secured two convictions against individuals who failed to comply, with one of the offenders being jailed after failing to pay the court-imposed fine.

In separate proceedings at the Kota Kinabalu Magistrate’s Court on June 16, both accused pleaded guilty to charges under Section 117(1) of the Consumer Protection Act 1999 that provides for a fine of up to RM10,000, imprisonment of up to two years, or both, for failing to comply with a tribunal award.
“In the first case before Magistrate Dzul Elmy Yunus at Magistrates’ Court 1, Noor Farizzah binti Usman, 36, failed to comply with the TTPM Award dated Oct 28, 2025, which ordered her to pay RM16,920 to the claimant.
“The Magistrate’s Court imposed a fine of RM1,800 or five months’ imprisonment in default against the accused. However, after failing to pay the fine, she was sent to prison to serve jail,” he said, Thursday.
In the second case before Magistrate Wan Farrah Farriza Wan Ghazali, Mad Mohammad Yassin, 71, pleaded guilty to failing to comply with TTPM Award dated Oct 27, 2025, which required him to pay RM25,000 to the claimant.
Shahril said the accused was fined RM2,000 or two months’ imprisonment in default. The accused subsequently paid the fine.
He said the total value of the tribunal awards that remained unpaid in the two cases amounted to RM41,920.
He said the prosecution was conducted by Domestic Trade and Cost of Living Prosecuting Officer Gunasegaran Krishnan and Assistant Prosecuting Officer Malai Rosidi Malai Muhamad, while both accused were unrepresented.
“These two convictions demonstrate KPDN Sabah’s continued commitment to ensuring that every award issued by the Malaysian Consumer Claims Tribunal is fully complied with.
“Prosecution action will continue to be taken against any party that refuses or fails to comply with tribunal awards to safeguard consumers’ rights and uphold justice,” he said here.
Shahril also urged members of the public facing non-compliance with tribunal awards to lodge complaints through KPDN’s official channels to enable enforcement action under the relevant laws.
