Kota Kinabalu: A former company chief executive officer (CEO) was freed from two counts of abusing his authority by awarding contracts totalling RM2,589,079.32 to a company he partially owned.
Sessions Court Judge Jason Juga discharged and acquitted Sulaiman Mohd Noor, 59, without his defence being called.

The court made the order after ruling that the prosecution had failed to establish a prima facie case against Sulaiman.
On the first count, Sulaiman allegedly used his position as CEO of YBS Tenaga Sdn. Bhd. to appoint Syarikat Pemborong Tambun Jaya, in which he was a co-owner, to carry out mechanical and electrical work valued at RM2,275,115.92.
On the second count, Sulaiman was alleged to have also used his position by appointing the same company to carry out maintenance work on a road in Kg. Minitampak 3 valued at RM313,963.40
The alleged offences took place on March 12, 2018, and Oct 2, 2017, respectively at YBS Tenaga Sdn Bhd office here.
The charges were framed under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same Act which carries a maximum jail term of 20 years and a fine of five times the bribe amount or RM10,000, whichever is higher, upon conviction.
The prosecution had called 14 witnesses during the hearing.
MACC Prosecuting Officer Nurul Izzati Sapifee conducted the prosecution while Sulaiman was represented by counsel Zahir Shah.
