Kota Kinabalu: A former company chief executive officer was discharged and acquitted by the Sessions Court here on two counts of allegedly abusing his position to award contracts worth RM2,589,079.32 to a company he partially owned.
Sessions Court Judge Jason Juga freed Sulaiman Mohd Noor, 59, without calling for his defence after ruling that the prosecution had failed to establish a prima facie case against him.

On the first charge, Sulaiman was accused of using his position as CEO of YBS Tenaga Sdn Bhd to appoint Syarikat Pemborong Tambun Jaya, in which he was a co-owner, to carry out mechanical and electrical works worth RM2,275,115.92.
On the second charge, he was accused of using his position to appoint the same company to carry out road maintenance works in Kg Minitampak 3 worth RM313,963.40.
The alleged offences were said to have been committed on March 12, 2018, and Oct 2, 2017, respectively, at the YBS Tenaga Sdn Bhd office here, with the prosecution calling 14 witnesses during the hearing, while MACC Prosecuting Officer Nurul Izzati Sapifee prosecuted and counsel Zahir Shah represented Sulaiman.
