The charge under Section 6(1)(c) of the Immigration Act 1959/63 provides for a fine of up to RM10,000, imprisonment of up to five years, or both, and is also liable to whipping of up to six strokes, on conviction.
The court extended the bail granted to Niko previously after he managed to provide supporting documents that proved he was born in Sabah.
Inspector Deanivo Sittin appeared for the prosecution while Counsel Sherzali Herza Asli defended Mohd Nico.
Mohd Nico whose detention recently drew attention on social media over the stateless issue in Sabah, was released on police bail before he was charged in Court.
