Kota Kinabalu: The Traffic Court here, Tuesday, fined a 68-year-old man RM5,500 or two months’ jail for careless and inconsiderate driving.
Umas B Kaling pleaded guilty before Magistrate Dzul Elmy Yunus to driving a Proton X50 without due care and attention at the Bataras Kolombong junction, on July 21, this year, at 7.46pm.
The charge stated that Umas’ actions resulted in a collision that caused serious injuries to motorcyclist, one Ag Dahlan Sailim, who was riding a motorcycle.
The charge, under Section 43(1) of the Road Transport Act (RTA) 1987 (Amended 1999), carries a fine of between RM5,000 and RM10,000 and liable to jail of up to 12 months on conviction.
The court heard from the prosecution that the police received a report at 8.30pm on the same day regarding an accident along Jalan Kolombong, opposite Bataras Supermarket, involving a car and a motorcycle.
Investigations revealed that the Proton X50, driven by Umas, was travelling from the Taman Nelly direction and was turning right into the junction when it was struck on its left side by the motorcycle coming from the Kolombong traffic lights towards the Kota Kinabalu–Tuaran road.
The driver was unhurt, while the motorcyclist sustained serious injuries and was rushed by ambulance to Queen Elizabeth Hospital I for treatment, said the prosecution.
A full police investigation found that the accident was caused by the car driver, who entered the junction without exercising proper care, causing the collision and grievous injuries to the motorcyclist.
The court also ordered Umas’ driving licence to be endorsed with the details of the conviction.
