Jailed, fined for using someone else’s MyKad
The offence under Section 25(1)(o) of the National Registration Regulation carries a jail term of up to three years or fine, on conviction.
TAWAU: A 50-year-old Indonesian was jailed 30 days and fined RM2,000 or another eight months for using someone else’s MyKad for nine years.

Arbain Jajji pleaded guilty before Magistrate Dzul Elmy Yunus, to using the MyKad bearing the serial number 800621-12-5953 under the name Bakri Abu Bakar.

Arbain committed the offence at 11.30am on Nov 27 this year at a house in Kg Rangga, Mile 10 Jalan Apas-Balung, here.

In meting out the sentence, the court stated that it was serious offence which involved documents and the real owner of the MyKad had been denied his rights as a Malaysian because of the case.

During mitigation, counsel Mark Rosaidey Mohd Amin asked for a fine only to be imposed on Arbain.

Mark informed the court that his client has two children, is suffering from asthma and claimed that his client is ready to lodge a police report so that investigation would be carried out against the syndicate involved where Arbain obtained and bought the document.

However, Prosecuting Officer Mohd Naser Mohd Nadzeri from the National Registration Department (NRD) urged the court to impose a deterrent sentence on the grounds that it was a serious offence and that the sentence should give a lesson not only to Arbain but public at large.

Mohd Naser said Arbain was an illegal immigrant and owned as well as used the MyKad since 2013 and the incident had caused the actual owner of the document, had been denied  his rights as Malaysian citizen.

The court heard that Arbain was working as a lorry driver was arrested for using the document.

Investigation revealed that during interview, the mother and brother of the actual owner of the MyKad said the document could not been issued to him (Bakri) because the MyKad had been issued to Arbain but under the actual owner’s name (Bakri).

After serving the jail sentence, Arbain was ordered referred to the Immigration Department for deportation.
