Kota Kinabalu: A Filipino labourer was on Tuesday sentenced to 12 months’ jail for unlawfully having someone else’s MyKad.
Jan Osman, 32, pleaded guilty before Magistrate Stephanie Sherron Abbie to having a MyKad under the name of Lester Boyston Ripin illegally at 6pm on Aug 4 this year at Yu Sang Kepayan here.
The prosecution informed the court that Jan was arrested by police during the OP PTI Bersepadu at the said place after he was found using the said document as his identification document.
Jan was charged under Section 25(1)(o) of the National Registration Regulation, which provides for a jail term of up to three years or fine on conviction.
He was ordered to serve the sentence from the date of his arrest and to be referred to the Immigration Department thereafter. In another case, two men were charged for having stolen items.
Store boys Mohd Fazil Srafsa, 26, and Mohd Khairun Rosli, 19, pleaded not guilty before Magistrate Jessica Ombou Kakayun to committing the offences at the One Rack shop at Alamesra Plaza at 6.30pm on July 30.
Fazil was accused of having a unit of a stolen solar lamp and stolen wok while Khairun allegedly had a stolen hair dryer and a cup set, which all belonged to their employer.
The accused were separately charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.
The court set Sept 20 for case management and ordered both accused, who hold IMM13 documents, to be remanded further. Fazil and Khairun were represented by counsels Mohamad Syazwan Shah Mohamad Ali and Lim Ming Zoong @ Lawrence, respectively.
Meanwhile, a 37-year-old man charged with attacking his wife with an iron rod, machete and a tie cable, will have his case re-mentioned on Aug 30.
Jerry James Marcus, during pre-trial case management of his case, maintained his not guilty plea to committing the crime against his 34-year-old wife at 10pm on Jan 1, in a house at Kg Tenggiling, Manggatal.
He had on Feb 17 this year claimed trial to the charge under Section 324 of the Penal Code which carries a jail term of up to 10 years or with fine or with whipping or with any two of such punishments, on conviction.
He was ordered to be further remanded. Inspectors Suzie @ Stephanie Kupit and Albert Basiri prosecuted.
