The centre was found to have operated without a licence under paragraph 19(a) of the Private Healthcare Facilities and Services Act 1998.
The offence was committed at 9.40am on Nov 6, 2024 at the Oceanus Wellness Centre premises here.
It was charged under Section 3(c) of the Act, punishable under Section 5(1)(b), which carries a fine of up to RM500,000 upon conviction.
The court heard that during a raid by the State Health Department’s Private Medical Practice Control Branch, two staff and three patients were found receiving treatment.
Officers also seized 11 items, including documents, machines and equipment.
Investigations found the centre had been operating without proper licensing.
Prosecuting officer Anis Nadia Ahmad Lathpi from the Health Ministry appeared for the prosecution, while counsel Siti Marzalia Murshidi represented the centre.
For record, the centre was previously fined RM55,000 by the Kota Kinabalu Sessions Court on March 16 this year for a similar offence.
